Point Made

Point Made: How to Write Like the Nation's Top Advocates [Kindle Edition]

Author: Ross Guberman | Language: English | ISBN: B00J3RGPR8 | Format: PDF, EPUB

Point Made: How to Write Like the Nation's Top Advocates
Free download Point Made: How to Write Like the Nation's Top Advocates for everyone book 4shared, mediafire, hotfile, and mirror link With Point Made, legal writing expert, Ross Guberman, throws a life preserver to attorneys, who are under more pressure than ever to produce compelling prose. What is the strongest opening for a motion or brief? How to draft winning headings? How to tell a persuasive story when the record is dry and dense? The answers are "more science than art," says Guberman, who has analyzed stellar arguments by distinguished attorneys to develop step-by-step instructions for achieving the results you want.
The author takes an empirical approach, drawing heavily on the writings of the nation's 50 most influential lawyers, including Barack Obama, John Roberts, Elena Kagan, Ted Olson, and David Boies. Their strategies, demystified and broken down into specific, learnable techniques, become a detailed writing guide full of practical models. In FCC v. Fox, for example, Kathleen Sullivan conjures the potentially dangerous, unintended consequences of finding for the other side (the "Why Should I Care?" technique). Arguing against allowing the FCC to continue fining broadcasters that let the "F-word" slip out, she highlights the chilling effect these fines have on America's radio and TV stations, "discouraging live programming altogether, with attendant loss to valuable and vibrant programming that has long been part of American culture."
Each chapter of Point Made focuses on a typically tough challenge, providing a strategic roadmap and practical tips along with annotated examples of how prominent attorneys have resolved that challenge in varied trial and appellate briefs. Short examples and explanations with engaging titles--"Brass Tacks," "Talk to Yourself," "Russian Doll"--deliver weighty materials with a light tone, making the guidelines easy to remember and apply.
In addition to all-new examples from the original 50 advocates, this Second Edition introduces eight new superstar lawyers from Solicitor General Don Verrilli, Deanne Maynard, Larry Robbins, and Lisa Blatt to Joshua Rosencranz, Texas Senator Ted Cruz, Judy Clarke, and Sri Srinvasan, now a D.C. Circuit Judge. Ross Guberman also provides provocative new examples from the Affordable Care Act wars, the same-sex marriage fight, and many other recent high-profile cases. Considerably more commentary on the examples is included, along with dozens of style and grammar tips interspersed throughout. Also, for those who seek to improve their advocacy skills and for those who simply need a step-by-step guide to making a good brief better, the book concludes with an all-new set of 50 writing challenges corresponding to the 50 techniques. All lawyers want to write winning briefs, so why do so few of us do it? I think Bryan Garner once said that the average judge considers only a small minority of briefs useful -- not good, just useful. I think a big reason -- maybe the biggest reason -- is that we don't have good examples. We base our work on prior work that other lawyers in the firm filed; they based it on other lawyers' work before that, and so on. Most of that previous work wasn't well written to begin with, and it gets worse with each iteration.

Ross Guberman is here to give you good examples. Tons of good examples, innumerable good examples, from the top legal writers in the profession. Examples from briefs by Ted Olson, Larry Tribe, Alan Dershowitz, Don Verrilli, Ken Starr, and many other famous lawyers fill the pages. Many of the attorneys here - John Roberts, Ruth Bader Ginsburg, Frank Easterbrook, and Barack Obama - later went on to bigger and better things.

Guberman then analyzes the examples and breaks down, step by step, how these masters of legal writing achieved the results they did, and how you can do the same. He shows how these lawyers select their theme, how they state the facts in the best possible way for their clients, how they eliminate surplusage from their statements of facts, and how their style contributes to victory. Each of these techniques is broken down into step-by-step instructions, with exercises to enable you to learn them yourself.

This book is a must-have for any attorney interested in their own professional development - which is to say, all attorneys.

I bought this book to get good forms for HIPAA consents etc in starting a new practice. It turned out not only to have a lot of legal details such as release of information forms and consent to privacy policies and consent to treatment, but it also had very good clinical templates which ended up changing some of my charting practices as well. It comes with a CD with every form in adobe pdf and word. The adobe forms can be printed out as is, and the word can be edited to suit your practice. It works in Vista with the new microsoft office word with no troubles. This book would be good for psychiatrists, psychologists, counselors or social workers in private practice or small clinic settings. It could also be useful for medical directors of mental health clinics as well. I wish it had been a little more inclusive of psychiatrists/pschologists with prescribing priveleges by having medication reconciliation sheets etc, but the author is very open to communication, and I may share some of my templates with him for the next edition. A good and very practical book to mental health practice nuts and bolts. This does not tell you how to practice or how to do therapy, it's just how to be an administrator of a mental health practice. But there is no book like it I have found!
By Brian D. Babiak
I am a minister for a small church and I wanted to expand an outreach ministry to include Pastoral Counseling in my community. I purchased this text to cut down on the time I needed to spend to draft all of my forms from the ground up. This text not only provided the forms that I needed, but many others that I had not even considered. Not only that, the text explained the rational for needing the forms and how they can be used by various counselors.

I am proud to say that this purchase saved me an incredible amount of money in the end in both time saved and attorney's fees. My attorney was impressed with the documents that I had tailored to my business. I must say this has helped my business in many ways.

Psychodynamic Psychiatry in Clinical Practice

Psychodynamic Psychiatry in Clinical Practice [Hardcover]

It is difficult to improve on a classic, but the fifth edition of Psychodynamic Psychiatry in Clinical Practice does just that, offering the updates readers expect and a deft reorganization that integrates DSM-5(R) with the author's emphasis on psychodynamic thinking. The individual patient is never sacrificed to the diagnostic category, yet clinicians will find the guidance they need to apply DSM-5(R) appropriately. Each chapter has been systematically updated to reflect the myriad and manifold changes in the 9 years since the previous edition's publication. All 19 chapters have new references and cutting-edge material that will prepare psychiatrists and residents to treat patients with compassion and skill. The book offers the following features: - Each chapter integrates new neurobiological findings with psychodynamic understanding so that clinicians can approach their patients with a truly biopsychosocial treatment plan.- Excellent writing and an intuitive structure make complicated psychodynamic concepts easy to understand so that readers can grasp the practical application of theory in everyday practice.- The book links clinical understanding to the new DSM-5(R) nomenclature so that clinicians and trainees can adapt psychodynamic thinking to the new conceptual models of disorders.- New coverage of psychodynamic thinking with relation to the treatment of patients on the autism spectrum addresses an increasingly important practice area.- Posttraumatic stress and dissociative disorders have been combined to allow for integrated coverage of primary psychiatric disorders related to trauma and stressors. A boon to clinicians in training and practice, the book has been meticulously edited and grounded in the latest research. The author firmly believes that clinicians must not lose the complexities of the person in the process of helping the patient. Psychodynamic Psychiatry in Clinical Practice, Fifth Edition, keeps this approach front and center as it engages, instructs, and exhorts the reader in the thoughtful, humane practice of psychodynamic psychiatry.

Gabbard cogently sums up the main categories of contemporary psychodynamic theory and has written a handbook that usefully guides the clinician in approaching clients from a psychoanalytic/psychodynamic perspective. Gabbard is well-versed in the research on efficacy, which is important in the era of evidence-based practice. Psychodynamic practice has not only a long history and a vast literature, but in recent years psychodynamic practice has been researched in well-designed studies and there is abundant evidence of its effectiveness for certain conditions and disorders.

Gabbard has entirely reorganized the text from the fourth edition. He held off until the DSM-5 was published, then reordered chapters and moved sections around to reflect the clinician's universe in 2014.

All in all, a wonderful book, and I am now going to look into his other American Psychiatric Association press texts.

I am pretty certain that if anyone reads this book they will be worse off because of it. i tried to compare some of the info from this book with other material, but this book is just such a waste of time. even if i had all the time to study this book, i wouldnt. this book wont help you be a better doctor and it wont even help you on the exam. rather, it will take away from both.
By Review
I recommend all doctors to read this book before writing Step 3 CCS. I tried various resources (Uworld, USMLE consult) but nothing really quenched my fear. But after reading this book I am feel very confident about my preparation. Dr. Fisher has done great job explaining all clinical scenarios in time and space with a thorough explanation. This book not only meant to get you through the USMLE Step-3 but it is full of "must know clinical medicine."

Full color text including tables and charts show that the full textbook is available in this Kindle edition. The weakness is in how to get to the sections you want on the Kindle. These sections are better on the Elsevier online version which this Kindle purchase also grants access. There are 3 areas they could improve to help the Kindle version a lot 1.) On the Kindle, the Contents Section has only 4 options: Cover, Table of Contents, Beginning and Location. The Index is not included. There are over 100 chapters, and the Table of Contents is expanded out to show the subsections for each Chapter. This means you have to scroll through 10-30 screens just to find the Chapter you want. On the Elsevier website online version, you can open or close the subsections for each chapter which makes the scrolling much less. They could improve the Kindle version a lot just by listing the Chapter Headings first before they show the subsections. 2.) The Index should be included in the Contents Section by alphabetic letter (Index for A, Index for B, etc.). 3.) The Search is also not very helpful. I did a search for Mastocytosis, which is actually Chapter 76. I got over 100 matches and it was not clear which one was the main topic. They should show the Chapter Headings first then show the links to other sections afterwards. On the Elsevier website online version, the same search shows 57 matches, but the Chapter heading is the first listing. They know how to do it on their online version, but did not put these features in the Kindle version. We can partially work around this by putting in Bookmarks on the Kindle, but it would have been nice if the publisher had spent a little more effort on the basic Chapter Heading and Index topics which would have made this work better on the Kindle. 4.

“This is a valuable reference for those treating geriatric patients, providing well-reasoned expectations. It offers a common-sense approach in a medical system that is oriented to procedure numbers rather than focused on what a rational outcome is. Medicine owes a debt of gratitude to the authors of this work.”

--Doody’s Review Service

For nearly three decades, the goal of Essentials of Clinical Geriatrics has remained unchanged: to help clinicians do a better job of caring for their older patients. You will find thorough and authoritative coverage of all the important issues in geriatrics, along with concise, practical guidance on the diagnosis and treatment of the diseases and disorders most commonly encountered in an elderly patient.

Features:

  • A strong focus on the field’s must-know concepts, from the nature of clinical aging to differential diagnosis of important geriatric syndromes to drug therapy and health services
  • Numerous tables and figures that summarize conditions, values, mechanisms, therapeutics, and more
  • Thorough coverage of preventive services and disease screening
  • An appendix of Internet resources on geriatrics

Recognizing the reality that medical issues interact with other social and environmental issues, Essentials of Clinical Geriatrics includes chapters on Health Services, Nursing Home Care, Ethical Issues in the Care of Older Persons, and Palliative Care. You will also find chapters on the differential diagnosis and management of confusion, depression, incontinence, falls, and immobility and general management strategies on cardiovascular disorders, decreased vitality, and sensory impairment.

There is no better resource to help you effectively address the challenges faced by the upcoming "grey tsunami" than Essentials of Clinical Geriatrics.

As an obstetrics provider, this is an excellent manual for helping deliveries progress naturally and decreasing your cesarean section rate. The book makes great suggestions for encouraging labor progress with position changes, etc before proceeding to medical interventions that also carry greater risk. Evidence-based with excellent references after each chapter. Perfect for anyone involved in the care of women during labor & delivery, including OB/GYN's, Midwives, MD's, RN's, and Doulas.
By williwaw36
I am a birth doula and I just finished reading through this book. I cannot believe how much information is in this book! It is well organized and provides evidence based ways to promote a "normal" labor. Though it was written for care providers, I can see the information in this book greatly helping me in future births. Not only do I have a greater understanding of what the nurses, midwives, and doctors are can do, but I can implement a lot of the interventions as well- such as knowing which positions help turn a baby who is OP. And when an intervention is beyond my scope, I can still explain to the family (if needed) how the intervention is designed to help.

The only reason I decided on a 4-star rating is for the Kindle version of this book. There were a few minor typos and grammatical errors. None of them made the material unreadable, but it was annoying.

Though most recover on their own, up to 20% develop chronic Posttraumatic Stress Disorder. For these people, overcoming PTSD requires the help of a professional.
This guide gives clinicians the information they need to treat clients who exhibit the symptoms of PTSD. It is based on the principles of Prolonged Exposure Therapy, the most scientifically-tested and proven treatment that has been used to effectively treat victims of all types of trauma. Whether your client is a veteran of combat, a victim of a physical or sexual assault, or a casualty of a motor vehicle accident, the techniques and strategies outlined in this book will help.
In this treatment clients are exposed to imagery of their traumatic memories, as well as real-life situations related to the traumatic event in a step-by-step, controllable way. Through these exposures, your client will learn to confront the trauma and begin to think differently about it, leading to a marked decrease in levels of anxiety and other PTSD symptoms. Clients are provided education about PTSD and other common reactions to traumatic events. Breathing retraining is taught as a method for helping the client manage anxiety in daily life.
Designed to be used in conjunction with the corresponding client workbook, this therapist guide includes all the tools necessary to effectively implement the prolonged exposure program including assessment measures, session outlines, case studies, sample dialogues, and homework assignments. This comprehensive resource is an exceptional treatment manual that is sure to help you help your clients reclaim their lives from PTSD.

Foa uses an exposure hierarchy for in vivo exposure. For imaginal exposure, she has the person go right to the most troubling memory and describe the different facets of the the experience. I suppose that she does that because if she tried to have them think of a less severe trauma, they would think of the most severe one any way; like trying not to think of pink elephants. She also does not (usually) have them do relaxation exercises during the exposure. IMHO, this is a great idea, as the tacit message of relaxation during exposure is that anxiety is bad. She does have people learn relaxation and grounding fore between sessions.

The book is great for beginners, and has examples of dialogue, much as Barlow has.

Foa recommended that the therapist and person meet "once or twice a week". Which is more frequent than most recommendations. She says that even if the SUDS do not decrease over the 60 minutes imaginal exposure, that overall desensitisation will have recurred: that is a relief to know.

Foa gives an excellent rationale for exposure. It is summarised on page 84 or 85 and given in more detail earlier in the text.
---1. Processing and organising the memory (I supposed this includes dealing with triggered automatic thoughts AND getting what happened as straight in one's mind as possible).
---2. Prompting differentiation between "remembering" the traumatic event and "being traumatised" (This is really good news to tell people).
---3. Promoting habituation.
---4. Promoting differentiation between the traumatic event and similar events (triggers).
---5. Increased mastery and sense of control.
